Nevada does not have Legislation at this point, however; our Legislative Session starts the first week in February so I will be watching to see what rears its ugly head. Our largest sheltered workshop (Opportunity Village) did try to get Grandfathered in for their new gated community that is adjacent to their workshop and it was shot down by Nevada Medicaid and CMS.

Subject: DD Councils Gated communities
We have a bill before the GA that would require our Mediciad agency to provide waiver funda regardless of where an individual chooses to live, I e the gated community in development. It was passed by indefinitely thanks to acknowledgments by at least some that it would violate CMS final rule. Others didn't care. Really... At some point the patron stated that 14 states were challenging this. I couldn't catch them all bit I recall DE, GA, and KY. Interested to know if states are challenging this and if legislation supporting gated communitiea has been put forth. I know I've asked a bunch of questions this past week and I greatly appreciate your help. The bill is dead today but perhaps not tomorrow
