We have legislation supporting gated communities, but not with the HCBS waiver under the new rules.   They did get however legislative appropriated HUD funding.

DE has no legislation to date. It's been a sincere battle. The Governor did write a letter to CMS before he left office to our surprise and chagrin. The P&A sent a follow up letter. The fight is not over. Keep us informed Heidi. Good luck!

We have a bill before the GA that would require our Mediciad agency to provide waiver funda regardless of where an individual chooses to live, I e the gated community in development. It was passed by indefinitely thanks to acknowledgments by at least some that it would violate CMS final rule. Others didn't care. Really... At some point the patron stated that 14 states were challenging this. I  couldn't catch them all bit I recall DE, GA, and KY. Interested to know if states are challenging this and if legislation supporting gated communitiea has been put forth. I know I've asked a bunch of questions this past week and I greatly appreciate your help. The bill is dead today but perhaps not tomorrow
