For Virginia Medicaid services, including waiver, our Medicaid agency has hearing officers on staff. For local decisions (our DD agency does not provide direct services) there are appeal processes at the local level but to my knowledge no impartial hearing officers. For human rights issues there are local human rights committee and a state human rights committee when someone is unhappy with the local decision

In Nebraska, the Director of our DD Services serves as the hearing officer when people file grievances or disputes about decisions made by their office regarding eligibility, service amounts, etc. A question has arisen about the need to have an impartial hearing officer at the agency level. Could you tell me who in your state hears these complaints or grievances – an employee of the agency or an impartial hearing officer? Thanks.
